IntroductionThese Terms and Conditions govern the use of services provided by RSA DOCUMENTS (“the Company”), a South African document procurement service assisting clients with document applications and submissions to government entities, including but not limited to the Department of Home Affairs, CRC, DIRCO, Embassies, and courts.
2. Services ProvidedThe Company offers assistance with the procurement, submission, and retrieval of documents on behalf of clients. This includes but is not limited to:
- Obtaining unabridged birth, marriage, and death certificates.
- Application for police clearance certificates.
- Apostille and legalization of documents.
- Embassy documentation and notary services.
- Assistance with court documents such as uplifting divorce orders
3. Client Responsibilities 3.1. The client must provide accurate and complete information and documentation as required for the requested services.
3.2. The client is responsible for reviewing and verifying all information before submission to avoid errors and delays.
3.3. The client is responsible for any fees, penalties, or other charges incurred due to incorrect information provided.
4. Fees and Payments 4.1. All service fees are payable in advance.
4.2. The Company’s fees are non-refundable once work has commenced, irrespective of the outcome, as services are charged for time and expertise, not results.
4.3. The Company reserves the right to adjust fees for services, which will be communicated to the client before any adjustments take effect.
5. Processing Time 5.1. The Company will make every effort to process requests promptly but does not guarantee specific processing times due to dependencies on government entities, third parties, and unforeseen delays.
5.2. The Company is not liable for any delays beyond its control, including but not limited to backlogs, administrative errors, or policy changes by government entities.
6. Limitation of Liability 6.1. The Company acts as an intermediary and is not responsible for the actions or decisions of government entities or third-party service providers.
6.2. The Company shall not be liable for any loss, damage, or inconvenience arising from the delay, refusal, or failure of government entities to process any application.
6.3. The Company’s liability is limited to the fees paid by the client for the specific service rendered.
7. Cancellation and Refund Policy 7.1. Cancellations must be submitted in writing.
7.2. Refunds will only be considered if the service has not commenced and will be subject to a cancellation fee .
7.3. No refunds will be issued once the application or service process has begun.
8. Privacy and Confidentiality 8.1. The Company is committed to protecting the privacy of clients’ personal information in accordance with South African privacy laws.
8.2. All client information is treated as confidential and will not be disclosed to third parties except as necessary to provide services or as required by law.
9. Amendments to TermsThe Company reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the client and will apply to future services.
10. Governing LawThese Terms and Conditions shall be governed by and interpreted in accordance with the laws of South Africa. Any disputes arising under these terms shall be subject to the jurisdiction of South African courts.
