Expungement
Expungement is the legal process of clearing and removing a criminal record from the National Criminal Register. To qualify for expungement, certain criteria must be met:
Eligibility Criteria for Expungement:
- A minimum of 10 years must have passed since the conviction.
- You received a sentence such as weekend imprisonment (Friday 18:00 to Sunday 18:00) or a community-based sentence.
- No further convictions or sentences without the option of a fine have occurred within those 10 years.
- The offence was related to:
- Minor crimes with minor charges.
- Politically motivated crimes, where the intention was driven by political or ideological reasons.
- Convictions based on race.
- Offences that, in a democratic society, would be considered minor or non-offences.
Disqualification for Expungement:
You will not be eligible for expungement if:
- You were convicted of a sexual offence against a child or mentally challenged person.
- Your name is listed in the National Register for Sex Offenders or the National Child Protection Register, unless removed from the register.
- You were sentenced for serious offences with incarceration and no option of a fine.
